格式條款的好處是，簡捷、省時、方便、降低交易成本。但是其弊端在于，提供商品或者服務(wù)的一方往往利用優(yōu)勢地位，制定有利于自己而不利于對方的條款。因此，合同法從維護公平競爭、保護弱者利益出發(fā)，對格式條款從以下三個方面進行了規(guī)范。

（1）提供格式條款一方在擬定合同條款及在訂立合同時，應(yīng)當(dāng)遵循公平的原則確定雙方的權(quán)利和義務(wù)，不能利用自己的優(yōu)勢地位制定不公平的條款欺負對方當(dāng)事人。同時，提供格式條款的一方當(dāng)事人應(yīng)當(dāng)采取合理的方式提請對方注意免除或者限制責(zé)任的條款，并按照對方的要求，對該類條款予以說明。

（2）在合同中規(guī)定，免除提供格式條款一方當(dāng)事人主要義務(wù)，排除對方當(dāng)事人主要權(quán)利的條款無效；具有合同法第52、53條規(guī)定的情形的，該條款無效。

（3）對格式條款的理解發(fā)生爭議的，如果有兩種以上解釋的，從保護弱者出發(fā)應(yīng)作出不利于提供格式條款一方的解釋；格式條款與非格式條款不一致的，應(yīng)當(dāng)采用非格式條款。非格式條款一般是在格式條款外另行商定的條款，或?qū)υ瓉淼母袷綏l款重新協(xié)商修改的條款，是當(dāng)事人的特別約定，如果與格式條款不一致，當(dāng)然采用非格式條款。
